The Federal Perkins Loan Program and the Federal Family Education Loan Program Final Regulations

    The U.S. Department of Education (ED) recently published a Federal Register, dated November 1, 2000, containing final regulations regarding loan discharge issues in the Federal Perkins Loan Program and the Federal Family Education Loan Program.  The regulations incorporate provisions contained in the recent reauthorization of the Higher Education Act (HEA).  The regulatory changes impact the following sections of 34 CFR:

Sec.  674.5      Federal Perkins Loan Program cohort default rates and penalties.
Sec.  674.9      Student eligibility.
Sec.  674.51    Special definitions.
Sec.  674.61    Discharge for death or disability
Part 682-Federal Family Education Loan Program
Sec.  682.200   Definitions.
Sec.  682.201   Eligible borrowers.
Sec.  682.402   Death, disability, closed school, false certification, unpaid 
                         refunds, and bankruptcy payments.
