New Regulations on Campus Crime Reporting
Final regulations issued by the Department of Education on November 1, 2002 corrected the definition of "Referred for campus disciplinary action" found in 34 CFR 668.46, by changing the word "student" to "person." The reporting of statistics related to sex crimes now apply to any person, not just students, referred to any campus official who initiates a disciplinary action of which a record is kept and that may result in imposition of a sanction.
As a reminder, schools were notified in UHEAA Bulletin Volume 2002 - Issue 54, that further changes to this regulation require disclosure to the campus community where law enforcement agency information concerning registered sex offenders may be obtained. This disclosure must be included in the school's annual security report beginning October 1, 2003.
